Terms of Use-1 (Terms of Service-1)

ProximaRide is registered and operates in Canada. It is a ridesharing service, recognized under the Canadian Transportation Act of 1996


1-    Contractual relationship    
The following terms are for use by the user: either a driver or passenger, while accessing services by ProximaRide. Use of and access to this service will be considered acknowledgement and acceptance of the terms of these services

 

1.1-    Scope and definitions
The definitions of new terms as they are relevant to ProximaRide are detailed below:

Definitions:
ProximaRide is a ridesharing service registered and operating in Canada, subject to the terms of service herein
Ridesharing is our primary focus. This stipulates that a car driver operating their vehicle will transport other passengers in exchange for a cost contribution, to be shared among the passengers as payment for the trip. The total contribution shall not exceed the total cost of the trip
The term general conditions refers to the general rules of good conduct stipulated in the good conduct charter by ProximaRide
Contribution refers to the monetary amount that each passenger gives to the driver for the ride. The cost is agreed upon in advance and payable upon arrival at the agreed destination
The passenger refers to a person who has agreed to ride as a passenger in the vehicle during the ride
The driver is the person who has been authorized by ProximaRide to use ProximaRide’s platform to post rides and find passengers for an agreed fee. They are in most cases the owner of the vehicle as well
Services constitute all functions explicitly stated under ProximaRide’s scope of duties

 

1.2-    Acceptance of conditions
Use of ProximaRide’s services implies an acceptance of the terms and conditions, as well as limitations provided by ProximaRide
ProximaRide allows users to access the terms and conditions. Each user is expected to read and understand these terms and conditions, and only move forward with their use of ProximaRide’s services if they agree to every and all terms and conditions 
Failure to read, understand and comply with the terms and conditions may lead to immediate termination of the user’s account without notice
Acceptance of the terms and conditions creates a binding agreement between each user and ProximaRide

 

1.3-    Modifications of terms and services
ProximaRide may modify, amend, alter, remove, or add to the terms of service at any time. Any amendments will take effect immediately and are binding

 

2. Use of service
2.1 The ride options
ProximaRide offers an online platform for connecting passengers and drivers with the aim of facilitating ridesharing among its users. ProximaRide offers four different types of rides:
1-    Regular Rides: the passenger is transported by any driver available for the route and time specified by the passenger
2-    Pink Rides: female passengers are only transported by female drivers; all other passengers must be female as well
3-    Extra-Care Rides: for those passengers seeking ProximaRide’s best rides, drivers, and cars, ProximaRide has selected a few search criteria and posts rides that follow them.

These criteria are: driving style (safe and no major accidents), driver's reviews and star rating, car's comfort (A/C & heating), no pets, no smoking

 

2.2 Accuracy of user information
Users wanting to use ProximaRide’s services will be required to create a user account which includes their official name, age, address, phone number and email address
User information must be accurate and meet all the required criteria in order for ProximaRide to allow access to the platform
Each user will only be permitted one account at any one time

 

2.3 Limitations and expectations
ProximaRide is a platform for connecting passengers with available drivers to facilitate ridesharing and is therefore not to be used for any additional services while claiming to be acting under direction of ProximaRide
The drivers are not allowed to profit off of the ride; they are simply allowed to recoup, but not exceed, their ride costs. The amount of the contribution of each ride will be posted on the ride’s page. By booking a ride, the passengers agree to that contribution
Any breach of, or actions contrary to, the terms and conditions can result in account termination with or without notice

 

2.4 Driver and passenger obligations
The driver’s obligations are as follows. Each driver is expected to fully comply with them at all times:
(i)    There shall be no criminal activity, including fraud or misrepresentation of services, on the part of the driver
(ii)    The driver must abide by all the laws and acts governing the ridesharing services in Canada 
(iii)    The driver is not allowed to do more than one round trip per day to any destination  
(iv)    They will adhere to the time and location agreed upon between themselves and the respective passenger(s)
(v)    If a driver changes the terms of the trip, they must make the exact nature of the change(s) known to the other passengers and to ProximaRide immediately. If these changes mean passengers are no longer able to ride, the passengers will be fully refunded
(vi)    The driver must arrive at the pick-up point at least 10 minutes before the agreed departure time
(vii)    The driver must be 18 years of age or older
(viii)    The driver must possess any and all relevant documents pertaining to their vehicle, insurance, driver’s license and legal right to drive in Canada
(ix)    The driver must wait for the passenger(s) for a minimum of 10 minutes after the departure time at the pick-up point. If a passenger is still no-show after these 10 minutes, the driver must call and inform ProximaRide before leaving the meeting point. If the ride is outside ProximaRide’s office hours, driver must leave a detailed voicemail message including the date, time, driver’s and passenger’s names, the arrival and departure times to and from the meeting point, and any other supporting or relevant information 

 

The passenger’s obligations are as follows. Each passenger is expected to fully comply with them at all times:
(i)    A passenger will not take part in any criminal or illegal activity during the trip
(ii)    The passenger must abide by all the laws and acts governing the ridesharing services in Canada 
(iii)    Each passenger will arrive at the agreed pick-up location at least 5 minutes before the departure time
(iv)    Each passenger shall inform the driver with adequate notice if they intend to cancel their trip
(v)    Each passenger will pay their agreed contribution to the cost of the trip
(vi)    Each passenger must agree to wait for the driver for a minimum of 10 minutes after the departure time at the pick-up point. If the driver is still no-show after these 10 minutes, the driver must call and inform ProximaRide before leaving the meeting point. If the ride is outside ProximaRide’s office hours, the passenger must leave a detailed voicemail message including the date, time, driver’s and passenger’s names, the arrival and departure times to and from the meeting point, and any other supporting or relevant information
(vii)    Each passenger must obey the rules stated by the driver. Failure to do so may cause the driver to refuse to take that passenger(s), cancel the trip, and, in extreme cases, drop the driver off before the end of the trip 
If any of the terms are breached by either party, further action(s) will be taken such as demerits displayed on their user profile or account termination

 

2.5 Insurance
The driver must maintain a comprehensive insurance policy, covering third-party as well as any passengers in the vehicle. The insurance coverage must contain comprehensive liability coverage as well. The burden of proof of insurance falls on to the driver. ProximaRide assumes no risk or responsibility in any cases where driver insurance is not adequate
Passengers have the right to request that the driver produce proof of these documents before embarking. However this is optional and will not be enforced by ProximaRide

 

2.6 Verification of documents
ProximaRide will verify the relevant information of those interested in becoming new users. This includes, but is not limited to: personal identification, work permits, address, phone number and email address. In addition, documented proof of insurance is required at all times

ProximaRide does not assume any liability in any cases. For more information regarding this please refer to Legal disclaimer
ProximaRide may not be held directly or indirectly liable for any damages of any kind with regard to the services offered

Key Sections:
Acceptance of Terms: Users must accept the terms to use the service. If they do not agree, they must refrain from using the platform.
Service Description: Explanation of the services provided, including the booking and matching process for drivers and passengers.
Account Creation and Responsibilities: Users must create an account, provide accurate information, and be responsible for maintaining the confidentiality of their credentials.
Prohibited Conduct: Any unlawful, abusive, or discriminatory behavior, such as harassment or the use of the platform for illegal activities, is strictly prohibited.
Cancellation and Refunds: This should include your cancellation policies—details about refund procedures for both passengers and drivers.
Limitations of Liability: Limiting ProximaRide's liability for any damages arising from the use of the service (including indirect or consequential damages).
Modification of Terms: We reserve the right to change the terms at any time, and users will be notified of any significant changes.
Governing Law and Dispute Resolution: The jurisdiction under which these terms are governed, and a mention of methods for resolving disputes (such as arbitration).

 

Terms of Use

General Use: Defines appropriate ways to use the platform, such as booking a ride, making payments, and providing accurate information.
User Conduct: Details the types of content users are allowed to share (such as reviews and comments) and forbids posting content that could damage the platform’s reputation.
Account Termination: We reserve the right to suspend or terminate accounts for violations of the terms of use.
Third-Party Services: Explains the use of third-party services (e.g., payment processors) and their respective terms of service.

 

Privacy Policy (Privacy and Data Protection Policy)

Introduction: We respect user privacy and are committed to safeguarding the personal information you share with us. This Privacy Policy explains how ProximaRide collects, uses, and protects your data.
Key Sections:
Data Collection: What personal information we collect, such as name, email, phone number, payment details, and trip-related data.
Data Usage: How we use the data, including improving services, customer support, and marketing.
Data Sharing: Who we share your data with (e.g., service providers, business partners) and under what circumstances.
Data Retention: How long we keep your data and how users can request its deletion.
Data Protection: How we secure your information using encryption, two-factor authentication, and other security measures.
User Rights: How users can access, update, or delete their data. Users can also withdraw consent for marketing communications.
Cookies: How cookies are used to improve the user experience and collect data on website usage.

Community Agreement (or Member's Agreement)

Introduction: The ProximaRide Community Agreement is a mutual understanding that governs the conduct and responsibilities of users in the ProximaRide platform.
Key Sections:
Respectful Behavior: Users agree to treat each other respectfully, fostering a friendly, safe, and welcoming environment.
Dispute Resolution: How disputes between drivers and passengers should be addressed, emphasizing the importance of communication and compromise.
Reporting Violations: Users are encouraged to report any misconduct or violations of community standards, and how these reports will be handled.
Accountability: Both drivers and passengers are responsible for their actions, and any failure to adhere to this agreement can result in account suspension or termination.

 

Driving Standards Policy

Introduction: The ProximaRide Driving Standards Policy outlines the quality and safety expectations for drivers to ensure every ride is safe and comfortable for passengers.
Key Sections:
Vehicle Requirements: All vehicles used for ridesharing must meet specific standards, including safety inspections, clean interior, and maintenance requirements.
Driver Behavior: Drivers must demonstrate professionalism, including safe driving practices, good communication with passengers, and timely arrivals.
Safety Protocols: Drivers must adhere to safety measures, such as wearing seatbelts, maintaining proper speeds, and following traffic laws.
Accident and Incident Protocols: What drivers should do in case of an accident or emergency, including notifying authorities and ProximaRide support.

 

Driver Code of Conduct

Introduction: The Driver Code of Conduct is designed to ensure that drivers provide the best possible service to passengers while maintaining high standards of professionalism.
Key Sections:
Professionalism: Drivers should maintain a courteous attitude and provide a safe, comfortable, and friendly experience.
Respect for Passengers: Drivers should not engage in inappropriate behavior, including harassment, inappropriate language, or discriminatory actions.
Handling Issues: Drivers should resolve any issues, complaints, or disputes with passengers in a calm and professional manner.

Non-Discrimination Policy

Introduction: The Non-Discrimination Policy ensures that all users of ProximaRide are treated fairly and respectfully, with special emphasis on providing safe and comfortable options for female passengers.
Key Sections:
Equal Opportunity: ProximaRide does not tolerate discrimination based on race, gender, religion, sexual orientation, or any other protected characteristic.
Pink Rides: Special rides for female drivers and passengers, designed to offer a secure and private experience for women. Men are encouraged to respect this and understand that it is designed for the safety and comfort of female users.
Reporting Discrimination: How users can report discriminatory behavior and what actions ProximaRide will take in response.

 

No-Show Policy

Passenger No-Show Policy:
Passengers are expected to arrive at the pick-up location at least 5 minutes before the scheduled departure time.
If a passenger does not show up, 100% of the booking price will be paid to the driver.
The booking fee is non-refundable.

Driver No-Show Policy:
If a driver fails to show up, passengers will receive a full refund of both the booking price and the booking fee.
Strict penalties will be enforced on drivers who repeatedly fail to honor their commitments.
